The Site is directed to people residing in the United States. We do not represent that Content available on or through the Site is appropriate or available in other locations. We may limit the availability of the Site or any service or product described on the Site to any person or geographic area at any time. If you choose to access the Site from outside the United States, you do so at your own risk.
Ticket Purchases:
We act as the agent to those who provide events, such as venues, teams, artist representatives and fan clubs, promoters, and leagues (“Event Providers”). Tickets obtained from unauthorized sources may be lost, stolen, or counterfeit, and if so, are void. We sell tickets on behalf of Event Providers, which means we do not set the ticket prices or determine seating locations. If you do not receive a confirmation number (in the form of a confirmation page or email) after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm whether or not your order has been placed. Only you may be aware of any problems that may occur during the purchase process. We will not be responsible for losses (monetary or otherwise) if you assume that an order was not placed because you failed to receive confirmation.
No Refunds or Exchanges Policy
All ticket sales are final. We do not offer refunds or exchanges under any circumstances, including but not limited to changes in personal circumstances, scheduling conflicts, illness, or any other reason.
Weather-Related Delays, Postponements, or Cancellations:
You acknowledge that outdoor events are subject to various weather conditions. You bear all risks associated with inclement weather, including but not limited to rain, wind, lightning, extreme temperatures, or other natural events that may impact the event. The event will take place rain or shine, and there will be no refunds, exchanges, or credits issued due to weather-related delays, postponements, or cancellations.
In the event that the weather conditions are deemed unsafe or otherwise unsuitable by the Event Providers or authorities, the event may be delayed, rescheduled, or canceled at the sole discretion of the Event Providers. If the event is rescheduled, your ticket will be valid for the new date, and no refunds will be issued. If the event is canceled due to weather conditions, no refunds will be provided.
Event Changes and Cancellations
Occasionally, concerts or events are canceled or postponed by the Event Providers due to unforeseen circumstances other than weather. Should this occur, we will attempt to contact you to inform you of refund or exchange procedures, if applicable. For exact instructions on any canceled or postponed event, please check the event information online or contact us. If the event is rescheduled, your ticket will be valid for the new date, and no refunds will be issued unless specifically stated otherwise by the Event Providers.
No refunds will be provided if an opening act, guest artist, or festival performer is changed or canceled.
Indemnification:
You agree to indemnify, defend, and hold harmless [Company Name], its affiliates, officers, directors, employees, agents, and partners from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (i) your use of the Site or attendance at the event, (ii) your breach or alleged breach of these Terms, (iii) your violation of any law or rights of a third party, or (iv) any actions or omissions by you in connection with the event.
Force Majeure
We shall not be liable for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by events beyond our reasonable control ("Force Majeure Event"). A Force Majeure Event includes, but is not limited to, acts of God, war, civil commotion, strikes, lockouts, industrial actions, terrorism, fire, flood, earthquake, epidemic, pandemic, governmental restrictions or any other event that is beyond our reasonable control. If a Force Majeure Event occurs, we will notify you as soon as reasonably possible, and our obligations under these Terms will be suspended for the duration of the Force Majeure Event.
Third-Party Services
We may use third-party service providers to facilitate certain aspects of the event, including but not limited to ticket sales, event hosting, and customer support. You acknowledge that these third-party services are provided by independent contractors, and we are not liable for any acts, omissions, or breaches by such third parties, including any failure to perform their services, negligence, or misconduct.
Disclaimer of Warranties
The Site and all content, services, and products available through the Site are provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, as to the operation of the Site or the information, content, materials, or products included on the Site. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You further agree that you will not participate in any class action or class-wide arbitration for any claims covered by this agreement.
Ticket Authenticity and Delivery
Tickets purchased on our Site are typically subject to a per-ticket service fee and a non-refundable per-order processing fee. Delivery prices may also apply. You may be limited to a specified number of tickets for each event (also known as a “ticket limit”). This ticket limit is posted during the purchase process and is verified with every transaction. This policy is in effect to discourage unfair ticket buying practices. We reserve the right to cancel any or all orders and tickets without notice to you if you exceed the posted limits. This includes orders associated with the same name, e-mail address, billing address, credit card number, or other information.
Orders are processed only after a billing address and other billing information has been verified. Occasionally, we receive incorrect billing or credit card account information for a ticket order that can delay processing and delivery. In these cases, we will attempt to contact you using the information provided at the time of purchase. If we are unable to reach you after our initial attempt, we may cancel your order and may sell your tickets to another customer without further notice.
Different combinations of delivery methods may be offered, depending on factors that include the venue or country where the event is to be held, the country in which you live, how much time is left before the event starts, whether it is a holiday season, and the nature of the demand for the event. Please carefully review the list of delivery methods offered during the purchase process. For security purposes, we can only ship tickets to the billing address on file with the credit card company that is used for your purchase.
Event Conduct and Assumption of Risk
Event Providers reserve the right, without refund of any amount paid, to refuse admission to, or eject, any person whose conduct management deems disorderly, who uses vulgar or abusive language, or who fails to comply with Event Provider rules. Breach of terms or rules will terminate your license to attend the event without refund. A ticket is a revocable license, and admission may be refused upon refunding the ticket’s face amount. A ticket is not redeemable for cash.
You agree that the event for which you purchase tickets is a public event, that your appearance and actions inside and outside the venue where the event occurs are public in nature, and that you have no expectation of privacy with regard to your actions or conduct at the event. You grant permission to us and the Event Provider(s) to utilize your name, image, likeness, acts, poses, plays, appearance, movements, and statements in any live or recorded audio, video, or photographic display or other transmission, exhibition, publication, or reproduction made of, or at, the event (regardless of whether before, during, or after play or performance) for any purpose, in any manner, in any medium or context now known or hereafter developed, without further authorization from, or compensation to, you or anyone acting on your behalf.
You and your belongings may be searched on entry to the event. You consent to such searches and waive any related claims that may arise. If you elect not to consent to such searches, you may be denied entry to the event without refund or other compensation. Under certain facility rules, certain items may not be brought into the premises, including without limitation, alcohol, drugs, controlled substances, cameras, recording devices, laser pointers, strobe lights, irritants (e.g., artificial noisemakers), bundles, and containers.
Violation of these Terms
We may investigate any violation of these Terms, including unauthorized use of the Site. We may provide law enforcement with information you provide to us related to your transactions to assist in any investigation or prosecution of you. We may take legal action that we feel is appropriate. You agree that monetary damages may not provide us with a sufficient remedy and that we may pursue injunctive or other relief for your violation of these Terms. If we determine that you have violated these Terms or the law, or for any other reason or for no reason, we may cancel your account, delete all your User Content and prevent you from accessing the Site at any time without notice to you. If that happens, you may no longer use the Site or any Content. You will still be bound by your obligations under these Terms. You agree that your abusive use of the Site may cause damage and harm to us, including impaired goodwill, lost sales, and increased expenses. You also agree that monetary damages for your abusive use of the Site are difficult to determine and that if you, or others acting with you, request more than 1,000 pages of the Site or make more than 800 reserve requests on the Site in any 24-hour period, you, and those acting with you, will be jointly and severally liable for liquidated damages in the amount of twenty-five cents ($0.25) for each page request or reserve request made during that 24-hour period which exceeds those limits.
Limitations of Liability
We are not responsible for providing transportation or reimbursement of travel-related expenses under any circumstances unless those items are specifically included as part of a package. We are not responsible for any delay causing you to arrive late or miss your event for any reason. If our actions result in you missing your event, we will not be liable for more than your total purchase price. We are not responsible for the conditions or the actions of the crowd at any event or for any changes made at the venue, including without limitation seating arrangements, stage setup, or venue conditions.
Balls, pucks, and other objects may fly into the spectator area during an event. Despite spectator shielding, injury can occur. Stay alert at all times before, during, and after play or performance. If struck, immediately ask an usher for directions to a medical station. You voluntarily assume all risks and danger incidental to the event for which the ticket is issued, whether occurring before, during, or after the event, and you waive any claims for personal injury or death against us, management, facilities, leagues, artists, other participants, and all of our respective parents, affiliated entities, agents, officers, directors, owners, and employees on behalf of yourself and any accompanying minor.
You acknowledge that the event for which you are purchasing tickets may be subject to various risks, including but not limited to inclement weather, equipment malfunctions, or actions by other attendees. You assume all such risks and agree that we are not responsible for any injury, loss, or damage resulting from these risks, except to the extent caused by our gross negligence or willful misconduct.
Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the state in which the event is held, without regard to its conflict of laws principles. Any dispute or claim arising out of or in connection with these Terms or the event for which you have purchased tickets shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Any arbitration shall be conducted on an individual basis, and no class arbitration or other representative action shall be permitted.
Miscellaneous
These Terms constitute the entire agreement between you and us regarding your use of the Site and the purchase of tickets. If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be enforced to the maximum extent possible, and the remaining provisions shall remain in full force and effect.
We may assign our rights and obligations under these Terms to any party at any time without notice to you.
